Glossary of New gTLD Terms

Trademark Owner: An individual or other legal entity that files an application for a trademark. The first-named applicant for a
trademark is deemed the owner of the application.

Trademark Assignee: A transfer of ownership of a trademark application from one entity to another is called an assignment. The assignee is the recipient of a transfer of a trademark registration from its original owner.

Trademark Licensee: An agreement between a trademark owner and one or more other parties that allows the other parties to make limited, specified use of a trademark. The licensee is the recipient of a license to use a trademark application or trademark registration from its owner.

Trademark Holder: The owner, licensee or assignee of a Trademark who appplies to have their trademark registered in the Trademark-Clearinghouse.

Label: The strings of text associated with a trademark record which are generated according to an algorithm of matching rules. These strings are the variations of domains that can be registered using that trademark record. When a trademark is registered in the Clearinghouse, part of the Signed Mark Data File will consist of the different possible domain names corresponding to that record.

Signed Mark Data (SMD) File: The file that is generated once the Trademark Holder fulfills the Sunrise Phase eligibility requirements. This file allows the Trademark Holder to register a domain name label within a New gTLD as long as they comply with that registry's policy. The SMD File is provided by the Clearinghouse, but it is the registry’s determination as to whether to accept the SMD file.

Sunrise Phase: Sunrise is the phase of at least 30 days following the launch of a new gTLD in which trademark holders can register protected trademark keywords as domains. The general public will not be allowed to register during this phase.

Claims Services: Trademark holders can begin using the Trademark Claims Service at the start of the Open Registration Phase of each new gTLD. When a domain registration is submitted, this service verifies whether a matching entry has already been submitted to the Clearinghouse. If so, a warning will be sent to the party attempting to register the domain notifying them that a corresponding trademark has been registered with the Clearinghouse and that the registration of the domain could potentially violate intellectual property rights. If the party attempting to register the domain decides to complete the registration, a notification will then be sent to the trademark holder, informing them of the domain registration.
